Before I write anything else - allow me to say that I believe that Nizar was being foolish to hope that the courts would dispense justice. As I said elsewhere, if the Nizar wins in this case, then the stolen jet engines must be in my backyard. As expected, the court came up with some silly excuse for a judgement - which Gani Patail lauds as being rooted in "very, very sound reasoning".
So let's move on ....

Malaysia was built based on the Westminster parliamentary system of governance by the founding fathers.

According to the Westminster parliamentary procedure, governments often respond to a vote of no confidence by calling for a confidence motion. Parliament passes or rejects the vote. Typically, when a vote of no confidence passes parliament, the government official must either resign or seek a parliamentary dissolution or general election.

Malaysia Boleh/ 1-Malaysia or whatever you call it, however, says otherwise. They say that that the voice of the parliament is irrelevant - and there is no need for a vote of no confidence.
We had today, the judgement in the case of Zambry vs, Nizar - to determine the rightful MB of Perak. It was for all practical purposes a test of the Constitutional Democracy which Malaysia was to live by. However, it appears that the Federal court doesn't seem to believe that we are a parliamentary democracy - that authority is vested in parliament as in a Constitutional Democracy.

I have not read the full judgement but it was reported on twitter that the Judge said:-
"There is no requirement in State Constitution which requires vote of no-confidence to be taken in State Assembly"
"Federal Court notes that test that Nizar had lost confidence of majority of assembly had been satisfied at special palace meeting."
Aha - so all they need is a meeting at a kopi-tiam, and get the head of state to sanction their choice. The court says that the constitution doesn't stipulate that that one is necessary. Apparently the judge said that Nizar is obliged to resign according to article 16 (6).

Okay then - let me see what it says:-

• Nothing in Article 16(6) says the sultan is involved in ascertaining a loss of the majority's confidence in the assembly.

• Article 16(7) expressly states that the menteri besar does not hold office at the sultan's pleasure. The sultan therefore has no power to dismiss or direct a menteri besar to resign.

• Article 16(5) also states that the executive council, which the menteri besar heads, is collectively responsible to the legislative assembly.

Strange .... but just as it doesn't say that a vote of confidence has to be taken, it also doesn't say that the Menteri Besar holds office at His Highness's pleasure or has to resign - in fact it states quite clearly that he is an exception from the ruler's "pleasure". It only states that the Executive Council does & has to. I really wonder how the judge came to such a conclusion- that the MB has to resign!!!
It seems that they demand specifics when it suits them, and they do not understand the principles of a parliamentary democracy or even why there is generality in constitutional law .....

So, the court believes that a band of thugs who happened to be elected into office can have a meeting with the head of state with his band of merry men to prove his majority. They do not believe that it is necessary for the majority to be proven through a vote of no confidence through a sitting in the Assembly!! Our "erudite" Attorney-General Gani Patail calls it a “very clear judgment with very, very sound reasonings.”

So there you have it - Parliamentary democracy has been subverted - or so it seems- by none other than the Federal Court itself!! What the Federal Court has effectively done today was to declare that the parliament/assembly is irrelevant. To me, what the Federal Court (Umno, actually) said today was simply this, "Screw the Assembly/Parliament - A "Palace Meeting" is enough to dislodge the Govt. As long as Umno gets power, all is fine and dandy!!"

For a nation to come crumbling down, there are but three kinds of people in leadership, with three different characteristics that is required, namely -

• the untamed passions in a gifted man,
• the wanton power in a weak man, and
  
• the unteachable temperament in a privileged man.

How "lucky" we are, that we have all three in just one man, who I shall leave unnamed.

Malaysia it seems, is sailing rudderless in the high seas of a Constitutional Monarchy. At the rate we have been going since the days of Mahathir - after this ruling, while there is minimal danger of the country becoming an absolute monarchy, it is just a matter of time before the Federal Constitution is abandoned, and Malaysia becomes "Talibanized" in tribal laws, or simply turns into a banana republic of sorts with a military junta like Myanmar.
So much for 1-Malaysia ....

Family rejects 'suicide' claim, wants independent autopsy

The family of a man, said to have committed suicide while in police custody, have refused to collect his remains from the morgue and are seeking another post-mortem. MCP Sawmill worker P Babu, 28, was found dead in the Jempol police lock up at about 4am after he surrendered himself in connection with a robbery case.

When contacted, Jempol MIC Youth chief M Palani said the first post-mortem report classified the death as suicide.
The deceased had apparently used his shirt to hang himself.

"But this is unofficial. We were told that we would get the black and white report within seven days," he added.

‘Strong willed person’

Palani said the family have rejected the findings because "Babu was a strong willed person and would not have this decision (to commit suicide)".

"We are also questioning the fact that he hung himself using his shirt. Shouldn't he be wearing a police issued t-shirt (for detainees)?" he asked.

Yesterday, Palani filed a police report calling for a thorough investigation into Babu’s death.

Both MIC and PKR politicians have cried foul over the incident and offered to help the family secure a second post-term.

For years, activists and politicians have been complaining about the high number of fatalities involving Indian Malaysian police detainees.

In January 2008, a police constable was charged with causing hurt to extract a confession from A Kugan, 22, who died in police custody in Subang Jaya.

In July, P Gunasegaran, 31, was found dead in the Sentul police station. An inquest is currently underway.

What the F**K!!!

I was very takut (scared) lor so I take off my clothes and wear a towel lor.

A friend and colleague just alerted me to this report in The Malaysian Insider. I couldn't believe my eyes when I read it. It actually is completely mystifying. You judge for yourself.

Mohd Saiful Bukhari Azlan, who took the stand at the High Court as the prosecution’s first witness, testified that when he first met Anwar at a condominium in Damansara Heights in 2008, the PKR de facto leader had asked him: “Can I **** you today?”

Wah! Anwar must have really been horny that day. Meeting a stranger and right away, "Can I FUCK you today?"

Saiful’s use of the profanity was greeted by sniggers and murmurs from those in the public gallery.

Well at least some people in the courtroom have a sense of humour or more likely they were tickled at hearing the word FUCK which is so often misused and misunderstood. And banned.

When asked by the prosecution about his immediate reaction to the request by Anwar, Saiful replied that at that point of time he felt “angry and scared.”

Okay, quite natural to feel that way. Of course, if somebody you met for the first time asked to fuck your ass wouldn't you get angry?

“I was angry and scared.. I refused to do so, to which Anwar became angry,” said Saiful.

Very good.

The complainant also alleged that the former deputy prime minister had offered him money in exchange for the sexual act, to which he also “refused”.

Good. Any God-fearing man would have done the same. Well done!

Anwar had then “ordered” him to proceed to the guest room where Saiful then stripped and donned a towel before the opposition leader hugged him.

Huh? Hahahahaha...you got to be kidding me. Right? After being angry and scared and refusing payment from the man you then proceed to the bedroom and strip down to a towel? Man! How scared were you? Not enough to protect your ass I guess.

According to wikipedia, Biro Tata Negara (National Civics Bureau, or simply BTN) is an agency of the Malaysian government in the Prime Minister's Department. It was established in 1974 as the Youth Research Unit (Unit Penyelidikan Belia) under the Youth Ministry, but was renamed and transferred in 1981.
That means, it actually morphed into the indoctrination monster that it is now, under the Mahathir administration from 1981-2003. Let's forget the "Avatar"'s statement lamenting the failure of Hitler's final solution (or about how the Jews should be massacred from time to time), for now.

BTN sure has reaped its harvests after a generation of indoctrination ...... so much so, that stupid racist words and ideas come out like second nature from from people in high office, even as they're under fire.
So there you have it from the horse's mouth - it popped out of this idiot, Nasir's mouth unwittingly at a 1-Malaysia forum- that Umno Malays believe that Non-Malays came in as beggars and prostitutes!!!

They don't care to see the truth that the older generations - older than the 1st generation opportunistic closet racists like Mahathir and Khir Toyo - came here to build the nation to what it is today. That too, they forget (or choose to ignore) that it is they who should be grateful that these "pendatangs" came and made life better for them - the new "BN/Umno bumiputra" elite. But now, with the money they robbed the people of through their cronies, arrogance and shit fill their bloated bellies and heads. They now conspire against these hardworking people using an ignorant vote bank whom they wish to manipulate- so as to hold on to power and further enrich themselves.

It appears that with the many scandals haunting them, flight of capital (50% of the RM 700b last year alone!!), economy crumbling, and the shrinking pie from which the can pirates pilfer the resources of the country- the sectarian/racist rhetoric is going into overdrive. They just cannot help themselves ..... they need to let out their frustration at the awareness of the people, and being demonized for their fascist/racist ideas and/or their agenda of piracy. Whatever they do, all their mindless actions (from cow heads, to pig heads, to burning churches) lead to only one thing - expressing the frustration they're feeling at their inability to rob the economy blind.

Even though he (Nasir) has been asked to resign, you can bet your last penny that he'll be given another cushy job away from the glare of the media (just like that teacher who called Indian school-kids "monkeys" in class, remember?). This frustrated individual will now be a hero to the (Umno Malay only) fascist groups like Perkasa and what not - and the mindless minions will now rally around him to express their frustration and apparent disenfranchisement.

Meanwhile, Najib and Umno will now have to show how it is that Umno/BN can prove that this is not so. The Chinese and Tamilian allies of Umno - MCA and MIC - will now have to prove that they still have some element of dignity in this racist political alliance.
We then have the **BTN going around spewing hatred, racism and bigotry in indoctrination classes for "Malay" undergraduates and civil servants separately. I wonder what these racist morons who support Umno think about that versus 1-Malaysia .....

**The BTN is a government agency in the Prime Minister’s Department and answers directly to the PM. This agency’s organisation and powers enable them to hold the nation’s civil servants and govt scholars by the balls.
This is because BTN courses are compulsory for all students of public institute of higher learning, government scholarship holders and civil servants. Failure to attend or pass the BTN courses would jeopardise their career prospects, academic assessments or aid/scholarship approvals.

Racism hinders Najib’s 1 Malaysia

KUALA LUMPUR, Feb 3 — Race relations, already aggravated by the ‘Allah’ row, attacks on places of worship and the Biro Tata Negara controversy, is in danger of spiralling out of control in Malaysia despite the resignation of Datuk Nasir Safar last night as special officer to the prime minister.

Political analyst Khoo Kay Peng, writing in his blog yesterday, called Nasir’s remarks that “Indians came to Malaysia as beggars and Chinese especially the women came to sell their bodies” at a 1 Malaysia seminar in Malacca a symptom of ugly racial politics.

“The question is why are we not surprised by Nasir’s allegations. Nasir is a symptom of ugly racial politics,” Khoo wrote.

The tone of Nasir’s remarks, especially when he allegedly warned Indians that the government could revoke their citizenships if excessive demands were made by the community, reflects a growing intolerance among many in Umno with the non-Malays particularly after the Hindraf 2007 march that put the government in bad light.

And Nasir cannot be considered a maverick speaking out of turn or a fringe minority within Umno. He was part of Najib’s team in government and was also a former Umno lawmaker from Johor, well-versed in government policy and the need to implement effectively and efficiently without a doubt.

The remarks made by Nasir is also not the first time an Umno official has caused major embarrassment for the party and the government with racist remarks.

The New Spinmeisters .... New Subversives.

Some of you might be wondering why I have posted the above pic again ....
There was a time some time back when "Mr. 1-Malaysia" lamented how his party "didn't know how to give their side of the story ...... But I have to hand it to him - he's managed to convince smarter people to help him out, where his party was sorely lacking. As such, he appears to have added a battalion of "intellectual spinmeister" mercenaries to his propaganda arsenal. As such, the propaganda blitz has intensified with a touch of sophistication & finesse, these days.

No it isn't the breed of crude & uncouth airheads like Awang Selamat or Abdullah Tee - those I speak of are much more polished and sophisticated, and are worthy "opponents" - to those who clamour for change from the usual Umno garbage. These breed do not make their allegiences obvious to those who are less discerning. Their mission is to deflect criticism from Mr 1-Malaysia, and get people to focus on apparently sensational issues and factors other than that caused by Umno's hegemony.

There is a current trend among "certain quarters", is to look for "ghosts under the bed" - so much so that parties like Umno & Perkasa are absolved of their mortal sins. Not just that - these sins are justified in any manner possible, using any religion, twisted logic, "intellectual discourse"/philosophy, public relations, advertisement or slogan to hoodwink the masses.

The issues have to be spun in any way possible to deflect culpability of these parties - "we cannot play the blame game"/ stop being "addicted"/ "it's larger than Umno"/ "don't politicize it" etc etc etc - are the catch phrases in these endeavor.

Going by the logic of these people, the only problem is that people don't understand the "pure & holy" intentions of Umno/ 1-Malaysia - becos the people are resistant to it, it isn't marketed well, they don't understand it (you can add the earlier spin to these ...).

You'll be surprised to hear these spin from the quarters that claim to be fighting for "the middle ground" but at the same time wouldn't fight for a more equitable Malaysia when push comes to shove.
Just like you - I too have been convinced for some time now that all the ills of our society have their genesis in our "Avatar" - Mahathir. To those who will not accept that - they'd say that I have a Mahathir fetish or that I'm am simply "addicted to him - while neglecting the fact that it is they who suck up to him, by justifying his persona & actions.

Look around you ... and look well - for "what the mind doesn't know, the eyes don't see".
You'll see many of them around .... Let's leave the "Avatar" who ruled for 22yrs out of the equation for now - there are others who are more subtle. As erudite as he may be, going by his articles in The Star - I would guess that Shad Faruqi is one of them (at least where the social contract, Perak & "Allah" issues were concerned). There are a few others whom I wouldn't want to mention - because they have disguised their pseudo-intellectual hogwash very well in the name of "seeking the middle ground" (don't confuse this with DAPs recent sloganeering of "middle malaysia" please) - while subtly spinning to subvert the Federal Constitution and absolving Umno of blame, in the blinded eyes of a public rendered confused and submissive through intellectual gobbledygook.

Indeed - as some say, the problem is bigger than "Umno" - for the cancer of immorality, hypocrisy, decadence and corruption has spread into every facet of life as we know it in Malaysia. Among all these elements, these "intellectual spinmeisters" (whether they do it by design or simply unwittingly) I speak of are by far, the most dangerous of all "elements" in our society today.
Until and unless we have identified, discredited & weeded out these subversives, Malaysian politics and economy will be in doldrums - no matter what the demographics may be.
