Religious Rights:- Reid/Cobbold Commission, The Secular Fed Consti, Penal Code

NOTE:- The following is being posted for the sake of information of those who challenge the Constitutional Liberties of those professing religions other than Islam, and their right to non-interference from the Islamic Enactments of various states or the KDN.
With this, it is hoped that those who wish to restrict the usage of Semitic words in the holy scriptures of Non-Muslims religions and consequently restrict the distribution of the Al-Kitab to Non-Muslims, will know that such actions are unconstitutional- and cease from such actions, lest it appears that they violate the Penal Code of Malaysia (Act 574) deliberately.
They should also be aware that Section 298A (7) of the Penal Code, states that-
It is also for the information of those who choose to demonize the Secular nature of the Federal Constitution (and consequently the Federation of Malaysia)- as the source of all ills today, and suggest that the Syariah is the panacea to all these ills.
To these people (and also the spin doctors of certain quarters), I hope a reminder that their rights to participation in the political process is subject to their loyalty to the Spirit of the Federal Constitution, and any treasonous attempt towards the subversion of the Federal Constitution using religious laws or twisted interpretations, would sooner or later push Malaysia into a state of Anarchy, Chaos, poverty and consequently a failed state.

57. There has been included in the proposed Federal Constitution a declaration that Islam is the religion of the Federation. This will in no way affect the present position of the Federation as a secular State, and every person will have the right to profess and practice his own religion and the right to propagate his religion, though this last right is subject to any restrictions imposed by State law relating to the propagation of any religious doctrine or belief among persons professing the Muslim religion.
59. At present there is no head of the Muslim religion in either Malacca or Penang, though in Penang the Government obtains advice in matters relating to the Muslim religion from a non-statutory Muslim Advisory Board. Since the Governors of these new States may not be persons professing the Muslim religion it is proposed that the Yang di-Pertuan Agong should be the head of the religion in each of these States and that the Constitution of each should include provisions enabling the Legislature to regulate Muslim religious affairs and to constitute a Council to advice the Yang di-Pertuan Agong in such affairs. These Councils will be concerned solely with Muslim religious affairs and they will not be entitled to interfere in any way with the affairs of people of other religious groups; and the position of the Yang di-Pertuan Agong as head of the Muslim religion will not carry with it authority to intervene in any matters which are the concern of the State Governments or to require the State Governments to make financial provision exclusively for the benefit of the Muslim community.

From time to time, I saw the word "social contract". I don't remember learning this in history subject (at least the fuller picture) in secondary school. This word appeared frequently when one tries to stress a point. Finally, I found one article that describes a more complete picture.
Dato’ Seri Dr Lim Keng Yaik’s keynote address at the Anak Malaysia Convention stirred up discontent among certain groups. He asserted that a political motivated reminder to the Chinese and Indian communities about the granting of citizenship as favour would be an obstacle to building a Bangsa Malaysia. And therefore, such “‘historical burden’ must be removed”

This remark, however, was taken negatively by some to be challenging the social contract upon which the nation was founded. Datuk Dr Ma’amor Osman, president of Muslim Consumers Association of Malaysia, said the statement “was purposely made to anger the Malays and other bumiputras and belittled Malay supremacy”

There seems to be a shift in interpreting and understanding the social contract. Some believe that there has been a misinterpretation of the history, while others think that social contract has been simplistically reinterpreted based on the premises of Islam as the state religion and the Malay supremacy (Ketuanan Melayu).
Historically, the social contract was originally the negotiation from various groups under the Reid Commission prior to 1957, before the drafting of the Merdeka Constitution.
Law experts have suggested that the contract must be read in light of both Reid Commission and Cobbold Commission reports.
Background
In 1956, a Constitutional Commission headed by Lord Reid came to Malaya for the drafting of a constitution for an independent Malaya. In the process, UMNO, the leading partner of the UMNO-MCA-MIC Alliance, was asked to agree to a ‘common nationality for the whole of the Federation’ (1). That would allow “all persons (in Malaya) to qualify as citizen either by birth or by fulfilling requirements of residence and language and by taking oath of loyalty” (2).
The leaders of the three communal parties agreed to first resolve differences and to speak with one voice to the commission. This was the origin of the social contract between the UMNO and the MCA leaders. MCA acknowledged that the special rights of the Malays should be protected, and UMNO in return conceded that Chinese and other non-Malays should be granted easier citizenship rights based on the principle of jus soli (by birth). The Chinese were also allowed to continue to play a dominant role in economy.
The Reid Commission’s draft proposals were published in 1957 and were then reviewed and amended by a working committee in Malaya, and representatives of the Alliance, the Malay rulers, and the British government at a meeting in London. Thus emerged the Merdeka Constitution (MC). Yang DiPertuan Agong was given the responsibility for safeguarding the “special position of the Malays” and the “legitimate interests of other communities” (3).
Before the establishment of the Federation of Malaysia in 1963, another consultative process was initiated with North Borneo (now Sabah) and Sarawak in 1962. From this process came forth a social contract (contained in the Cobbold Commission Report) similar to the consensus acquired in 1956-57.
The core of the contract as stated in the memorandum submitted by the Alliance was that Islam was to be the State religion, but the “observance of this principle shall not impose any disability on non-Muslim nationals professing and practising their own religions and shall not imply that the State is not a secular state” (3)
The Merdeka Constitution(MC) provisions evidently provided the framework for the 1963 Federal Constitution. The latter continued to cover the provisions of special rights and privileges of the Malays, national language, and religion without depriving “any person of any right and privilege, permit or license accrued to or enjoyed or held by him” (Article 153). It also included “several other issues which were/are matters of contention between the Malays and Chinese” (2).
In short, the Constitution, formulated in 1957 and 1963 through consultation and consensus of the nation’s founding fathers, is based on the social contract on which the country is founded. The Constitution “ epitomises a social contract among equal partners that promises equality of all citizens – regardless of race and religion – in a pluralist democracy,” said Dr Ng Kam Weng, director of Kairos Research Centre (The Star, Nov 15 2003).
At the King’s birthday last year, the Prime Minister, on behalf of the government, vowed to hold fast to the social contract by protecting all ethnic groups against any form of oppression or discrimination (Star, Jun 6 2004).

Agi Idup, Agi Ngelaban ...

In his recent autobiography the late Rev. Brother Michael Jacques reminisced: "I have never lost the spirit of always being a Sarawakian and am proud of it. No matter how long I have been away, my roots are in Kuching where I came from," giving a subtle signal as to why the autobiography was titled ‘The Man from Borneo”.

Jacques was always proud of his French-British-Hakka ancestry. He speaks at length of his mother, Chin Jin Khoi, who was married to a labourer and opium addict, Soon Huat. It was not a happy union and so Chin married William Harry Jacques, a teacher at the Chung Hwa school.
In his teaching career spanning 48 years, Michael Jacques, served twice as Brother-Visitor in the La Salle provincialate of Malaysia-Singapore-Hongkong. He was also the first Asian elected to the post of Assistant Superior General of the LaSallian Christian Brothers headquartered in Rome. He was recently conferred a Datukship by the Penang State Government.
His teaching career took him from his idyllic hometown in Kuching to Penang, Ipoh, Malacca, Singapore, Bangkok, Colombo, Hongkong, London and Rome.
Strikingly, in the last leaf of his 390-page epistle, this educationist seems to have prophesised his absence at the launch, penning in Latin:"Dum spiro spero" (While I breathe, I hope)....incidently the motto of the illustrious fighting band called theSarawak Rangers....or the Iban equivalent: Agip Idup, Agip Ngelaban.*
And as if intended as an epilogue to his Latin musings, the last three lines of his memoir read: "We should never despair while we still have life. I shall have to make the best of it. My watchword is to live as authentic a life as possible, for the relatively short time remaining to me."
*The motto of the Ranger Regiment is Agi Idup Agi Ngelaban. A direct translation, word for word from Iban to English is "Still Alive, Still Fight." In spirit the motto means "Fight to the Death." It is conjectured that the motto was derived from Brooke family's Latin motto, Dum Spiro Spero which means "While I Breathe, I Hope." In this light, Agi Idup Agi Ngelaban could mean "While I Breathe, I fight." Dum Spiro Spero was the state motto for the Kingdom of Sarawak. In the other, according to the Journal of 1st Ranger Regiment, the motto Agi Idup Agi Ngelaban was derived from "Whilst There Is Life, There Is Fight", also noted as Brooke's family motto. The Royal Ranger Regiment is the only corps of the Malaysian Armed Forces using this motto in the Iban language.
Bro Michael Jacques, former Bro Theoderat Michael, was my superior. We did not get along well but I always respected this great pedagogue from a distance. Most times it always is better this way. Farewell Brother Visitor.
La Salle director for Malaysia, Brother Anthony Rogers, incidentally an Ops Lalang detainee, in his citation during the launch of “The Man from Borneo”, said it all about Jacques in just three words: "Someone for all".

Or it remain only concept on his fingers?
How is Barisan Nasional to defend Perak when officials in Government and Government-sponsored institute do not heed our warning and remain stubborn? And then come out with a reply that avoids the issue and tries to bullshit and lie.
Does he think we are stupid or something?
It is a discomfort for this blogger to be expected to restrain himself and not play his role because there are those who believe Perak is not quite you call a safe state and one eye should be closed to wrongdoings.
In fact, it is because if Perak is not quite you call a safe state, there is more reasons that there should be no compromise on good governance, efficient use of state resources, and combat against wrongful practices of corruption, cronyism and nepotism or KKN, as some faction in UMNO used to call.
If BN is to lose Perak now, not a single sen must be allowed to leak for some politician to make hay while sunshine.
It is because honesty, integrity and effectiveness in governing and bringing peace, harmony and abundance to the rakyat will be the premise for the people to yearn to see BN return to power.
Barisan Nasional wants to remain in power in Perak forever, thus small things must not be allowed to add up to be a problem.
With that bit of sermon, the response by Institut Darul Ridzuan (IDR)'s CEO, Aminuddin Amin's (read in Perak Today here) on our allegation of the wrongful manner in the appointment of Talent Solution as consultant for PEKA (read past posting here and here) is best described as a dud.

In case, Aminuddin or anyone would like to point fingers or blame others for this bloggers writing, mind you that is an insult. This blogger is quite aware that Aminuddin have been openly expressing that thought.
Let me say this to him, "F**k you!"
This blogger answers to nobody and can be told by nobody. This blog is not one of those that mushroomed after BN's loss after 2008 and need to be encouraged, trained and taught to blog. No offense intended to those bloggers.
In case this mother*ucker does not know, this blog existed since 2005, 6 *ucking years ago. This blogger have been in the political cyberwar defending BN and UMNO since the reformasi days and have a sleepy Prime Minister with a wicked son-in-law as casualty in his batch of honour.
Don't ever *ucking say that someone can *ucking tell me to write this and that. I will write what I want to write and at my own time, *ucker!
Because I have been insulted, my reply will not be kind.
How can Aminuddin deny that Talent Solution is not his crony and claim that the individuals involved in the company have been in the business for 15 years?
Read back what is written here and tell us how he could make such claim?
Kota Damansara based, Talent Solution is only registered three month ago. The two Directors of Talent Solution are Wan Azrain, former Education Manager with NCER and Amie Yusnizar, administrative assitance with an American bottling plant in Petaling Jaya.
Both of them probably never had a total 15 years employment experiance. Neither have they any recruitment or job placement experiance nor are they Perakians.
Aminuddin was quoted on video saying, "Yang lebih penting, kita juga mengambil faktor semangat syarikat ini yang mana tunggak Talent Solution ialah anak jati Perak dan mereka ini mahu bersama-sama IDR untuk membangunkan negeri ini."

Sex and the Decay of the M'sian State
First, the recent pornographic screening of a sex video in a hotel for the press involving a foreign sex worker is an assault on all women. Prostitution and pornography harm women. Prostitution commodifies women, exploits their poverty and powerlessness.
Pornography portrays women as sexual objects and men as consumers of a sex industry dominated by corruption, crime such as trafficking of women.
How is it possible for a foreign woman to work as a sex worker in a KL spa without the knowledge of the police, the Immigration and City Hall? Aren't these authorities monitoring the activities of spas? (I am hearing women now fear going to spas as they seem to be fronts for prostitution and there are cameras to capture women showering, having a massage.)
The screening of this video in government-owned Carcosa Seri Negara is not possible without state sanction.
One of the trio involved is an Umno stalwart, former chief minister, current chairman of Risda - the association to protect the interests of rubber smallholders, who have remained poor and powerless. The chairman has abused his powers as head of a government organisation to use a state facility to screen a pornographic video. (Former Malacca chief minister Abdul Rahim Thamby Chik, businessman Shazryl Eskay Abdullah and Pertubuhan Pribumi Perkasa Malaysia (Perkasa) treasurer Shuib Lazim, have admitted that they were part of the 'Datuk T' trio responsible for keeping and screening the video to members of the media at Carcosa Seri Negara last week.)
The chairman should not only be charged with breach of section 292 of the Penal Code but also perhaps with corruption. Transparency International defines corruption as abuse of power.
But a Minister in the Prime Minister's Department has announced that the purveyors of the sex video would be offered protection under the Witness Protection Act as well as the Whistleblowers Act if there is a case against them. (He later made an about-turn.) This will defeat the purpose of these two pieces of legislation in cases related to rape, child abuse and corruption, etc.
Pillars of integrity decaying rapidly
The national pillars of integrity are decaying rapidly when those who have breached laws of the country are assured protection by the state. Have we begun to revere those who flaunt laws to kill political opponents? Once we have reached such a stage, crime and corruption become non-issues in the election of political representatives.
Parliament is a fundamental pillar of a nation's integrity system. Parliament must comprise of individuals of integrity. Parliament will lose whatever respect it has if it is going to be filled with those who have abused their positions, bribed and rigged themselves into power.
Said Niccolo Machiavelli, “Those who talk about the peoples of our day being given to robbery and similar vices will find that they are all due to the fact that those who ruled them behave in the same manner.” When the incidence of crime such as robberies, rape, child abuse, corruption etc increase, it is a reflection of a decaying legislature .
The executive used sex in 1998 to send to jail Anwar Ibrahim, a political opponent the state feared. After serving a six-year jail term, the conviction against sodomy was overturned. But the significant gains made by the opposition in 2008 rang alarm bells for the state (the party in power). Again, sex became the weapon for seeking the demise of a powerful opponent. Anwar is on trial for the second time on charges of sodomy.
The role of an important pillar of integrity, an independent judicial system, is central for a just, open and accountable government. The overturning of the first sodomy charge against Anwar speaks volumes about the independence and accountability of the judiciary. Was the judiciary independent of the executive in this sex and the state case? The revelations of a former director-general of the Anti-Corruption Agency, Shafee Yahaya (right), during Anwar's trial throws light on the interference of the executive in the functions of the ACA.
Shafee's court statement was related to former prime minister Dr Mahathir Mohamad's directive that the ACA cease investigating then Economic Planning Unit director-general Ali Abul Hassan Sulaiman in June 1998. In his recent memoirs, Mahathir referred to Shafee as a hostile witness in the sodomy case. Shafee is a rare civil servant who stood up for the truth.
When the state uses sex to stay in power, the decay of the pillars of integrity such as the Parliament, police, judiciary, ACA, local authorities, Immigration, media and civil society becomes imminent.
Information central to integrity system
It has been said power is about controlling the means of communication. But information is central to a nation's integrity system. A free media and an independent judiciary are powerful counter forces to check those in positions of power. The Malaysian media, particularly the mainstream media's reporting of the ongoing sodomy case and screening of a sex video obviously favours the proprietors of the media. The media owners are primarily political parties in the ruling coalition. I have yet to see an editorial condemning the use of sex by the state to kill political opponents. The mainstream media appears to have gone into damage control mode to protect those who screened the sex video.
Civil society, another pillar of integrity, gains its legitimacy from promoting the public interest. The sex video is a matter of grave public interest. In the 1998 sodomy case, children were asking parents: what is sodomy? Today I am told, some young people are asking, “Why are grandfathers involved in the screening of sex videos??”
What message are we sending to our young? That it is all right to use sex to get rid of your opponents?? Civil society, particularly, women's groups, religious entities, parents, etc must stop this rot.
When the state uses sex as a weapon to destroy political opposition, political leaders will not be remembered as statesmen but as practitioners of gutter politics.

Alhamdulillah kerana kita semua masih bernafas lagi dgn keizinanNya. Saya ingin berkongsi dgn rakan2 semua tantang tarian pocoh2 yang sedang hangat ditarikan oleh semua lapisan masyarakat,umumnya masyarakat kita yg beragama islam terutama suri2 rumah dan badan2 kerajaan ketika manghadiri kursus.
Sebenarnya tarian pocoh2 ini berasal dari Filipina bukannya dari Indon.Ia ditarikan oleh masyarakat yg berugama kristian ketika mereka menghadiri upacara sembahyang mingguan mereka.Lihatlah sahaja bagaimana pergerakannya, yg membentuk salib.
Mungkin kita x perasan kerana kita suka mengikut2 sesuatu yg baru tanpa usul periksa. Inilah cara musuh2 islam mengenakan kita sedangkan kita tahu apabila kita melakukan sesuatu yg menyerupai sesuatu agama maka kita dikira merestui agama itu seperti amalan yoga yg telah difatwakan haram kerana menyerupai agama hindu.cuma tarian pocoh2 ini belum difatwakan haram lagi. Marilah kita sama2 fikirkan.
