Nizar's back!!! Dissolve The Assembly Now!!

KUALA LUMPUR: The High Court here ruled rule on Monday that Datuk Seri Mohammad Nizar Jamaluddin is the rightful Perak Mentri Besar, and not Barisan Nasional’s Datuk Seri Dr Zambry Abdul Kadir.

In an immediate response, Zambry said he would apply for a stay pending appeal. This was rejected by the court.

Nizar left the courtroom saying he would seek an audience with the Sultan of Perak, Sultan Azlan Shah, to get his consent to dissolve the Assembly and call for fresh state elections.

He would make his request for the audience at a state function at the Istana Kuala Kangsar Tuesday morning.

In his ruling Monday, Justice Abdul Aziz Abd Rahim said that a new mentri besar could not be appointed as the office had not been vacated.

He said a mentri besar can only be dismissed by a vote of no confidence, and upheld the Stephen Kalong Ningkan ruling.

He noted that the Perak State Legislative did not hold a vote of no confidence.

Happy Wesak! Respect My Speech!

Today we have the Chief Pirates of Malaysia wishing all Buddhists a Happy Wesak, extolling the virtues of Buddhism, Buddhists and their organizations. To add insult to this injury, they would at the same time try to draw parallels with the Umno/BN regime which stands diametrically opposed to anything that preaches virtue.

Incidently, I had a very vivid dream last night - after reading some "stories" on the internet. There was this grand old man who was the head of the family & clan, who had returned home for a yearly celebration. He was much revered by his children and all members of the clan.

As per protocol in this traditional family,

all of them gave him a warm welcome with much pomp and splendour. This year though, he came with company - a new concubine (that's a polite way of saying "whore") supplied by the thugs/pimps who worked "for him" in his vast business empire.

Before he took his seat at the head of the table, in full view of the whole clan, he got his bodyguards to drag the mother to his children (who objected to his philandering) by the hair- out of the dining hall amidst much protests from his children, and approval & praises from his bastard children. The concubine then took the seat of the mother to his legitimate children, beside him.
Meanwhile prior to the customary speech (no - it wasn't an officiating speech)before the meal, the bastard son said grace, thanking God for the food on the table.
When the children protested once again, with much composure and "grace" he warned them with his arms around the whore,

"If you want to remain here & work with me, Respect my speech!"

That was my dream - I then woke up to this "Happy Wesak Day"!
BTW, Najib & Hishamudin are the Santa Claus & Santarina ......

Police mockery of right to legal access

THE Malaysian Bar strongly condemns the arrest last night of five lawyers at the Brickfields police station who were there to represent their clients.

We are shocked and disgusted by this blatant transgression of the rule of law. By their action, the police personnel in question have demonstrated utter disrespect and blatant disregard for the criminal justice system that they are duty-bound to uphold and protect. They have violated the specific provisions in the Criminal Procedure Code guaranteeing access to lawyers. Although there is an exception to this provision, it cannot by any stretch of the imagination be turned into a right to arrest lawyers who are waiting to render legal representation to their clients.

The police action makes an absolute mockery of the constitutional right to legal representation and is a travesty of justice. We call on the Inspector-General of Police to immediately explain this gross abuse of police power.

This unprecedented conduct by the police has far-reaching consequences. It means arrested persons can be denied access to their lawyers without challenge. And when their lawyers are denied access and are forced to wait outside the police station, the lawyers themselves are at risk of arrest.

We acknowledge all our colleagues who have come to the aid and defence of those arrested by the police simply because they have chosen to exercise their fundamental right to assemble peaceably.

We salute our colleagues from the Kuala Lumpur Legal Aid Centre — Fadiah Nadwa Fikri, Murnie Hidayah Anuar, Puspawati Rosman, Ravinder Singh Dhalliwal and Syuhaini Safwan — who, without regard for their own safety and well-being, voluntarily went to the aid of those arrested, only to be arrested themselves. They have exhibited great courage and by their actions have demonstrated the highest standards of the Malaysian Bar. Their exemplary sense of duty and professionalism stands in stark contrast to the despicable conduct of the police.

Christmas is coming early this year, guys. The Pirates of Perak have got their loot, and now it's time to throw some Lollies at the "losers" - us the people!

Hishamudin, being armed with his arsenal of security/enforcers in the PDRM (as he's now the Home Minister), has little reason to wave the kris. No more threats, no more calls for "uprisings".
His job now is to snuff out any form of dissent - constitutional or otherwise. It is all his prerogative. He now can order arrests with total impunity.
He can also take away or give you your freedom with no reason whatsoever. But of course the copper will tell you that they need 1001 investigations & reports they have to make before that is done under the ISA. However, you can rest assured that in the Malaysia Boleh spirit, these things can be done in a jiffy - like the time they put that journalist (Ms. Tan, I believe) in the slammer "for her own safety & protection".

Going by the above statement they can also get lawyers out to represent detainees arrested, before they can even turn around and say "WTF"!!
So who says Hisham the Kris-man isn't a nice guys. Who says we need the law or a constitution. We only need Hisham in the Home Ministry and the PDRM which answers to him, under Umno/BN to take care of the country. See what nice leaders we have .....

After the BN government sponsored coup d'etat, with Perak now under the rule of Pirates who have made mincemeat of democracy and all the institutions that are its pillars (that too, graced by a Raja Nazrin who apparently "didn't officiate - but just gave a speech" which had to be "respected", to kill some time, of course), it is now time for "santa claus" to dish out some goodies.

Yes it's time to see the "goodwill" of pirates turned santa claus! It's time to sing praises to Hishamudin, the Kris man who now shows what a caring Umno/BN regime we have!

There is also the possibility of regimes stealing elections but losing power after failing to effectively repress popular protest...... Limited polls have been stolen nonetheless because autocrats estimated the costs in acknowledging defeat - a loss of reputation or the creation of “oppositional islands” - as too high.

Quoted above is the abstract of a paper which I posted here under the title Crouching Monkey, Wounded Tiger (I of III) on the matter of "election/power stealing" phenomenon in many third-world states. Read also in the same post, papers which made Malaysia a case study of "third-world" regimes in the same league as Egypt. With the Perak fiasco, the Umno/ BN regime has once again shown its primitive attitude, and vindicated the "western intellectuals/media" it is so prone to demonize.

It is a sad day for Democracy in Malaysia.
Today, without formally convening of the assembly, a new speaker was installed despite having the motion rejected by the legitimate speaker. They have used brute force, and not the law/Constitution to remove the Speaker from his seat.

As I had mentioned during the aftermath of the 080308 tsunami - the aristocracy has inevitably expressed their contempt for the rule of law and democracy, and have unleashed their vengeance - and their anger has by no means been cooled. There's more to come, and the PR would best be on guard.
It was something I expected about six to eight months down the line. However, that it had taken this long is probably evidence of the problems faced among the elements of the ruling elite in theBN/ Umno regime. The Barisan Nasional Government has shown that it does not care for anything other than the Power to rule.
The electorate are robbed of their legitimate rights.
The Federal Constitution is "Dead".
The State Constitution is "Dead".
The Judiciary is "Dead".
Rule of Law is "Dead".
The "PDRM" is "Dead".
Democracy is "Dead".

Only the Army remains (a scary thought, but does it actually still remain?) ......
The rest have all been emasculated, and "Kuganized" - and illegitimate bodies led by thugs have usurped their powers to install goons or puppets in their place.
Save in a few states under the Pakatan Rakyat governments, Malaysia is fast descending into lawlessness - enforced by pirates who have installed themselves into the seat of power. Malaysia will soon be officially declared a "pariah state" with a pariah institutions of state - which has interestingly been official.

I will not pretend that this was something which was unexpected any more than that pirates wouldn't take losses without playing dirty. However, to the PR - this is also a test of their allegiance to the head of state. I'm certain that all PR leaders knew this as well. It is just that they have displayed much restraint so as not to provoke "civil strife" - which is exactly what the pirates want.
They are looking for an excuse to trigger violence of some sort, and didn't get it. It is for this reason that DSAI was not to be seen anywhere near the venue of the confrontation.

Maybe patience would be the order of the day as HRH Sultan Azlan Shah quoted from the Quran,
“O you who believe! seek assistance through patience and prayer; surely Allah is with the patient. (The Cow 2.153 )”.

What we have seen is actually a mortally wounded animal unleashing its fury with all its might in its throes of death. Let it be known that this is just the beginning.

It is the beginning of the end of Umno/ BN - and there will be more injustice heaped upon the people before it dies.

No power can survive without the media. With the MSM media which has been widely discredited for spinning lies, this BN/ Umno regime will not last long - maybe not even 5 yrs.
They have lost the propaganda war, and now it is just a matter of time before this illegitimate government falls. They have just signed their death warrant - and it will be a slow and painful death ..... with their eyes wide open.

Malaysia is today not just a "Police State", but also what Noam Chomsky would call a "death squad democracy" which is ripe for economic colonization, after the plunder by the pirates we've had thus far.
The only question now is, if the army will sooner or later "intervene" to keep the country in one piece .......
