BogeyMan: Chin Peng, May 13 & Najib's "1MALAYSIA" Hypocrisy

ADDENDUM
Something Hilarious as I started my day, and I had to put it up:
"AirKosong" has provided a link to the PwC Audit Report on the PKFZ (now projected to cost a whopping RM 12BILLION) which was initiated during the time of Mahathir/Ling Liong Sik- he got it by entering the name "Najib Altantuya" with a fictitious IC number!!
This "mistake" I believe, is however quite deliberate since they have promised to make it public to the media- in that "certain quarters" are playing a "big game" in trying to discredit the previous administration of Mahathir/Ling Liong Sik and their camp in the current Umno/MCA.

PUTRAJAYA, April 30 — Former communist leader Chin Peng today failed in his last bid to live in Malaysia after the Federal Court here upheld two lower courts’ decisions compelling him to produce his identification documents before he can be permitted to enter this country.
Justices Datuk S. Augustine Paul, Datuk Hashim Yusof and Datuk Wira Ghazali Mohd Yusof made the decision after dismissing Chin Peng’s motion for leave to appeal.

Chin Peng, whose real name is Ong Boon Hua, was appealing against the Appeal Court’s decision on June 20, 2008, which ruled that he must produce his birth certificate or citizenship to prove that he is a Malaysian citizen before he can pursue legal action against the government.

In a bid to destroy the rising anti-colonial forces and the CPM, the British colonial authorities arrested thousands of Malay youth who were demanding independence in early 1948. And in June 1948, it declared a State of Emergency and banned the CPM and other anti-colonial and labor organizations. The CPM was left with no choice but to resort to an armed struggle for independence.
The Haadyai Agreement stipulated that the CPM would disband all armed units and terminate all armed activities. All weapons would be destroyed and CPM members would locate and destroy all landmines it placed in Malaysia. The Malaysian government would pay medical costs for any CPM members injured while removing landmines.
For these concessions, CPM members who wanted to re-establish legal residence in Malaysia could do so after spending at least 6 months in pre-designated places in Thailand. Those taking residence in Malaysia would have to swear allegiance to the King and abide by the Federal Constitution and laws of Malaysia.
The CPM leadership has since ensured scrupulous implementation of the agreement. But Chin Peng's petition to return to live in Malaysia has been denied to date.

The official stand is taken despite the peace agreement signed between the MCP and government on Dec 2, 1989, stating that party members who were of Malaysian origin should be allowed to settle in the country if they wished to do so.
Chin Peng’s mistake was that he did not take up then Premier Tun Dr Mahathir Mohamad on that offer immediately.
Much of the reluctance to allow him to return stem from challenges that are embodied in Chin Peng’s very existence, to official discourses about the origins of Malaysian independence. Firstly, communists such as Chin Peng (real name Ong Boon Hua) were practically the only Malayans fighting the Japanese invaders during World War II.
They did it with material and logistical support from British defenders who had recently so hastily abandoned their colonies in Southeast Asia.

Chin Peng is therefore a reminder of a fractious time when the Japanese were seen as invaders by some but as liberators of Malaya from British control by others.
The portrayal of communists as terrorists was therefore a narrative device that served to depict British colonialists as defenders of decent government, protectors of the public and willing participants in bringing independence to Malaya, in the final days of their empire.

The May 13 Incident is a term for the Sino-Malay race riots in Kuala Lumpur (then part of the state of Selangor), Malaysia, which began on May 13, 1969. The riots led to a declaration of a state of national emergency and suspension of Parliament by the Malaysian government, while the National Operations Council (NOC or MAGERAN) was established to temporarily govern the country between 1969 and 1971. Officially, 196 people were killed between May 13 and July 31 as a result of the riots, although journalists and other observers have stated much higher figures. Other reports at the time say over 2,000 were killed by rioters and police and Malaysian Army rangers mainly in Kuala Lumpur. Many of the dead were buried in the Kuala Lumpur General Hospital grounds in unmarked graves quickly by soldiers of Malaysian Engineers.
The government cited the riots as the main cause of its more aggressive affirmative action policies, such as the New Economic Policy (NEP), after 1969.

According to Bernama, a senior state MIC leader revealed that the former women, family and community development deputy minister had received the blessings of Samy Vellu.
"In a husband-wife relationship there are bound to be fights and disagreements but this does not mean that we have to divorce. That would not make a happy marriage..... My relationship with Palanivel is the same. We are like a husband and wife team," Samy Vellu was said to have told the division leaders.

MAHATHIRISM - Reloaded.....

(Note: I'm numbering the points I wish to make today- lest some aging grey matter of mine looses track of them, half-way through reading. Just f%#* the parts my selective @$$ of a memory fails me ....)

1. One way of adulating a politician in power, is to demonize and paralyse the opposition - and give himself pats on the back for pea-brained ideas/ventures (e.g. Bakun Dam, Proton, KLCC, OPV projects) through an idiotic and servile MSM.

2. When a Chinaman across the causeway labels you as an “ultra”, you use it to your advantage- and prove it in your party, by giving all mega-buck contracts to your cronies and party minions while you bleed the ignorant rakyat. make sure though, even if you have to give the most measly contract, you gotta make sure you get your cut ..... at least in the form of what you may call "goodwill investment".

3. It took me decades to live it live it up. When I was Prime Minister there was consternation among many Malays that a “non” could become one. But look at me now - how they "worship" me ..... ! What was .... (hmmmm.....I'm sorry my aging grey matter doesn't permit me to finish this sentence - refer to ChePet.cc for further details on this sentence)

4. However, by the time I stepped down I had managed to lie to the Malaysian morons, in such a way that befits that description. In the 1999 Election it was Chinese votes which helped give me the 2/3 majority in Parliament, because I managed o scare the hell out of the MCA Chinaman (and the Semi Value worshipping MIC Tamilans) with plenty of horrific news about “Islamic extremists”. All I needed to do was to have the blame murders/ assasinations of nons pinned on some vague KMM, Al Maunah (which incidently got their arms from an army depot - during the time of "apanama" as defense minister) or whatever - who cares anyways.
Along with that, as per the Umno method, I also threatened a little 513 lah …. however, they humiliated me later by giving Bodowi a 90% vote in the following elections. These freakin' bus-turds – I'll get them through my baby moron who is now a high-profile deputy minister …....

5. Now the doomsday label is Mahathirism, and it makes my poor old decrepit heart beat with pride. Such was the fear of this thing called Mahathirism that they had to do a Perak on the public to reinforce the fear. The foreign press and the local non-MSM seem to correctly imply authoritarian Government with Mahathirism.

6. No one has yet described the rule of Dato Seri Abdullah Badawi as Badawism. It must be because he is said to be liberal and free from authoritarianism. But is he? Relatively speaking, very much so. But then again, they could've at least used the term Bodowism or something like that.

7. It appears to be simply because the mainstream media, print or electronic, is totally controlled by him through his hatchet man, Kalimullah. However, because Malaysians grew up and resorted to the blogs for information, he wasn't as effective as the media goons in my time.

8. Until the bloggers came into the picture and their blogs became extremely popular as they reported the truth, the black-out was effective. Smart fella this Kali guy - Kali's media reports some of the news and views appearing on the blogs. Meanwhile, my spin-doctors are still clueless as to how to appeal to the masses – and now I have to resort to being a BUM speaker to recruit fresh talent.

9. Anyway, I still don't know why I'm pissed that the general public is not cursing authoritarianism of Abdullah. Just like my time, Ministers and civil servants critical of him have been removed. Many are in cold storage. Tan Sri Sanusi Junid - my dedicated henchman since 1988 Umno elections, who was President of the International Islamic University was one of those removed. No one has been appointed to his vacant place yet.

10. All these, of course aren't as spectacular as my adventures with Tun Salleh Abbas or Anwar, but it was the same tactic – so why don't they curse him? Correct.
Correct, Correct, Correct - In my time, a whole bunch of judges working with the UMNO owned judiciary had to resign, to be replaced by V.K. Lingam's nominees from the sidewalk. Ask Zaki – he'll tell you ….

11. But Corect. Correct, Correct, correct. Linggam has friends amongst the gutter politicians. So we shouldn't complain about Mahathirism. But publicly people have given all kinds of uncomplimentary labels to the 22 years of misrule by the fourth Prime Minister of Malaysia.

12. After the Perak coup d'etat and bundling out the Speaker like a sack of potatos, the arrests of people bearing candles and cakes or even wearing black, by now people can draw their own conclusions as to whether Mahathirism is reloaded .....
as Jibby-ism (some call it "Mongolism").

Raja Petra does not turn up in court, again

Malaysia Today editor Raja Petra Kamaraudin failed, again, to appear for his sedition trial at the Sessions Court here on Friday.

DPP Shah Rizal Abdul Manan told judge Aslam Zainuddin that the arrest warrant issued on April 23, when he also did not turn up in court, had yet to be executed on him.

He also said a notice for the editor’s wife Marina Lee Abdullah to summon her to explain Raja Petra’s absence at the sedition trial was also not executed.

Raja Petra’s lead counsel J. Chandra applied to the court to adjourn sine die (idefineitely) for the case until the police succeeded in arresting his client.

“I'm worried because the opposition have spun the story around. Our problem is, we're not as good at telling our side of the story. That's all,” he said.

Mahathir's BUM address ....

Recently there was this event called BUM 2009- The event was apparently a runaway hit, especially since they had star appeal in none other than Mahathir, our exPM. Many Malaysians actually "worship" him - much like how Semi Value used to be treated by his minions in the past (There actually is little difference between them, although I must say unlike Semi - Mahathir has polish, brains and some class).
Without a doubt, he is definitely an icon among Malaysians, simply because he ruled for the entire significant lives of many an enslaved mind, and his views are much sought after (even if it is gibberish) by them. Most Malaysians don't realize that we never really needed Mahathir (or his "asian values"/ "strong government"). We just needed good governance and accountability- to achieve the progress we did in the 90s, while riding on the global economic boom (until the bust, i.e.).

However one has to be honest - it must be said without a doubt, that he is a politician par excellence in the Malaysian context (where as a result of his "guidance", we are left with the bums he has left behind in the corridors of power), and (for better or worse) he has carved his place in Malaysian history and the hearts/minds of Malaysians. For that, I would still respect and salute him - despite the fact that I think that he was a very clever dictator, who knew how keep up the pretense of nurturing a democracy and an apparent prosperity.

Malaysiakini, did post the videos - although as expected, there wasn't anything really significant, I somehow liked some of what I heard (not the twisted "truths", though)!!!
Incidently, yours truly wasn't really willing to pay good money to listen to what the man had to say - and hence didn't attend/participate. One reason being, his approach towards Freedom of the Press, which was in total contradiction to the practice of subtle persecution and intimidation during his time at the helm. But of course - it wasn't his fault! It is the MSM that has to blamed for being chicken (or simply infected with the much dreaded illness called Bodekitis) and attempting to "second guess" him, despite the fact that he had never restricted.
Poor guy this, Mahathir fella- apparently he had to "behave according to the sentiments expressed in the media", and it apparently wasn't that the media was sucking up to him!! I suppose one can only have "sympathy" for the predicament which Mahathir was in as a result ...... right? Yeah brother ... "I feel you" - and it breaks my heart!!
No wonder he called them BUMS for listening to his nonsense!! (He "neutralized" it by calling the "VIPs", though .... smart fella this Mahathir - and dumb f%$#s these BUMs are).

Even so, I liked his silly jokes (besides the above joke, i.e.) in the part about how internet porn is peddled on the www. He sure has the makings of a comedian. It is nice to see an old man still having his sense of humour intact, and a very sharp mind (for his age).
Anyway, despite a runny nose, he looked quite well at the BUM 2009, and I wish him good health.

Self Righteous Voices of Guilt & Remorse ...... through Walls of Straw

Of late, we had much discussion on 513 - "a day that will live in infamy".
We also got "mixed signals" coming from the most unlikely sources .....

We had some apologists (Refer to Jebat Must Die's -May 13th 1969 – The "Correct" View which comes in two sad parts) attempting to justify the actions of security personnel - by painting the "other side blacker than black" with one broad brush.

On the other hand, we had an element of remorse in the voice of Abdullah Ahmad (The Critical 30 minutes) - an aide to Tun Razak, and a former NST Editor. He implied in this article, that it was because of the delay in communications that the whole event proceeded as earlier planned.
I quote -
"The tragic and vicious incident need not have happened had Tun Razak's message to Datuk Harun Idris, the Mentri Besar of Selangor, reached him 30 minutes earlier or had Tan Sri David Tan Chee Khoon and Tun Lim Chong Eu spoken to Razak 30 minutes earlier relaying their decision not to cooperate with DAP to form the state government of Selangor nor to work together in Perak and elsewhere.
I was beside Razak when he took the calls from them late past tea time on the fateful evening of May 13. I recall clearly what Razak told Harun,"…the good news is you will continue to run Selangor. Chee Khoon and Chong Eu had just spoken to me that they want status quo preserved. So tell the people gathering at your house to disperse."


From the above, it is quite clear that it was within their power to prevent the bloodshed, and as to who the architects of the incident were. That it was "too late" to prevent it from breaking out is I suppose quite another matter altogether, as the intention for the bloodshed, and the "reasons" (as opposed to the excuses of JebatMustDie) were quite clear.
Now - if that isn't a damning indictment (no matter what pathetic "communist excuses" Jebat may bring forward to justify it), I really don't know what is.

Be that as it may be, much water has passed under the bridge. It would not do for us to hold it against them - provided their actions warrant it in their actions & policies. It wouldn't be right for us to hold it against the culprits (read Umno) should they confess their sins and express remorse - just so that we can move forward as a nation with a common ideal and destiny.

For what it is worth, let us give credit where it is due. It was at least courageous of Abdullah who (probably due to the "haunting spectre of guilt") has come forward with this "veiled remorse" in his winter years. This has to be something that we have to take in the right spirit, should we seek reconciliation, the "Bangsa Malaysia" or "1Malaysia" which we all strive for. So let us refrain from spewing hatred upon the present for the mistakes of the past.

However, there is an element of "fear" in Umno, that they would be subject to a "backlash" should they acknowledge the past. While that may be partly unavoidable, this backlash that they fear cannot be prevented through their denials or their lame "justifications" for the bloodbath. Thanks to the Mahathir years, Umno in inevitably in its sunset years - and as such, this backlash that they fear will in no way be as bloody as in was on 513.
If anything, they'll only lose political power - and nothing more. What is important here is the fact that all communities understand that whoever leads Malaysia would swear allegiance to the Federal Constitution, and that nobody would be sidelined or victimized based on past misdeeds of their predecessors.
Let us then "clean up our cup from the inside" - offer an olive branch just so that we can move on and heal together as one nation.

To those who bear the burden of confusion, hurt and guilt, here is a short message from Ravi Zacharias which is quite relevant to the "illness" that afflicts our nation:-

What do we do when we have committed a wrong that we are ashamed of? What can we do with those wrongful deeds that we can’t seem to erase from our consciences?

One way that many people deal with guilt is to cover it up. This can seem almost instinctive at times, as if something inside us says, “Hide it. Forget about it. No one can know.”

But this puts us in a very precarious position, for not only are we dealing with guilt, but now we are dealing with the fear of being “found out.” When we add fear to our feelings of guilt we are adding apprehension to the remorse we are struggling to conceal. Just as a blackmailer is never satisfied, so the one who lives in fear with guilt ends up blackmailing his or her own heart to pay the mind.

But the heart is never consoled, for the mind is never sufficiently paid.

Guilt that is concealed seldom stops with the one who harbors that hurt. Sooner or later that pain of fear and guilt is spread to others, particularly to those closest to us. “Victimless” crimes are an illusion, for deceit is a monster that needs constant feeding. It would be foolish for us to think that we can deal with guilt by somehow covering it up. The moment that we cover our guilt we escalate the tension in our lives by adding the dimension of fear. We may then become people who seem okay on the outside, but inside we are struggling to maintain the facade.

Many used this same ploy with Jesus in his day. They would throw one question after another in order to hide the real struggle beneath them all. He says to those who have tried to cover over their guilt, “Woe to you...for you clean the outside of your cup, but inside the cup is full of turmoil...First clean the inside of the cup so that the outside may become clean as well.” Here Jesus refers to the heart as a cup. What you pour forth will show the condition of your heart, even if the “outside” looks clean.

Carried to a different level, this same tendency underlies all our national preoccupation with one social or economic crisis after another. No one seems willing to admit that at the heart of our malady is a mangled spirituality.

Let us go to God with our “cup full of turmoil,” so that we may not live in fear, but in hope.

The Post 513 "Umno-cracy": Majority or Legitimacy?

On this 40th anniversary of May13, when bloodlust ruled the streets of Klang Valley, I'd like to state that IMHO, Malaysia isn't a democracy - at least since that day. Malaysia, has since been a racist aristocracy practicing apartheid enforced by the "instruments of state" - more so since the advent of Mahathirism. As a matter of fact, one wouldn't be too far off the mark to say that Malaysia has since, always been, and is still a Police State - albeit, clothed in a Constitutional Monarchy which apparently practices Parliamentary Democracy - in a nation of ignorant, hoodwinked & politically emasculated citizenry (although there has been an element of awakening over the last two years).
The BN - It has always been and is still a government which wastes the labors of the people, under the pretense of taking care of them. Never mind the sin and tyranny of it all - they don't hesitate for a moment enforce to their "gunboat diplomacy" majority, in their pursuit of personal wealth and power.

"In the running of a democracy, we cannot allow the tyranny of the minority to decide for the majority."
Those were words of Zambry who was speaking as a faithful henchman and spin-doctor to "certain quarters" who were bent on acquiring power for themselves even if it meant destroying the very institutions they claim to defend. This is the guy who at one time challenged some journalist or other and asked him if they knew what democracy was -or something to that effect.

While Zambry proceeds with his attempt at subverting democracy on the pretext of defending the rule of the majority, little does he seem to understand the reason for democracy as a system of governance. He appears to be ignorant of the fact that democracy lives on "Legitimacy".
Majority or not, he has forgotten (or is ignorant) that the people are the ones who decide in a democracy - and not the rulers.

Jefferson once characterized the people (Notes on the State of Virginia) as the "safe depository of the government" and that "governments degenerate when trusted to the rulers" . As such, he said that "the true corrective of constitutional abuses, is to return it (the mandate) to the people who can make "informed choices" through education, as opposed to taking it away from them. This however wouldn't gel with Zambry's (or PDRM's) notion of a "democracy".

Incidentally, what the BN bunch (epitomized by the above statement) advocated since the time of Mahathir - the Asian Values cum Nanny State - is diametrically opposed to this concept of democracy which they claim to defend. The BN argument is this - as long as they have a majority in a parliament, they are "democratic". The methods of achieving it does not count in their brand of democracy - hence the "Asian Values".
For BN, the ends justify the means. It is quite possible that if they have to intimidate, harass, kill or even possibly sell their mothers to gain that majority- in their eyes, it is perfectly legit & democratic - or else it is "the tyranny of the minority".

Let's forget the ISA/ Police Act/ EO and what not for a moment - to date, one political party squandered billions on the PKFZ and OPV, Sukhois and Scorpenes, gang-raped the Federal Constitution, gambled on oil futures, MISC, Forex. Then manipulated and humiliated the Monarchy, sacked judges, arrested lawyers out to defend constitutional rights of citizens, banned civil society groups and candlelight vigils, arrested bloggers and peaceful civilians, got court orders to declare certain colorful fashion statements seditious, dragged out the speaker like a sack of potatos, arrested joggers or patrons of eateries for having roti canai ... and the list goes on ad nauseaum, ad infinatum.

It is but a futile effort for us to try educating these bunch of goons - in fact, they have despised the intellectuals ever since the infamous days of Ops Lalang under Mahathir. Just like any gangster would, they do not see intellectuals as "prophets", but as a nuisance. They would despise Tun Dr. Ismail's words warning of an uprising of the people, should they abuse the constitutional process. Sadly however, reason was thrown out of the window among the "mutineers of 1969". They would wholeheartedly probably agree with Mao Ze-Dong's convictions that "power comes from the barrel of a gun", and nothing more - therefore the infamous May13. (Who knows what Altantuya or Rosmah might say to this, right?)

In keeping with Mahathirist "traditions", any attempt to educate them on the need to respect Law or the Federal Constitution in it's original form is met with much scorn (for more, feel free to browse through CheDet.com entries of August 2008). Judges and Lawyers are only good to serve them- and not the law. The same goes for all other institutions and intellectuals/ academics/literati - and the vacuum is filled by installing highly decorated, incompetent & glorified pretenders/ puppets, so as to hoodwink the masses with their imbecility. To justify and facilitate this travesty, the sectarian agenda is played out for an unsuspecting public. Just like the prophets of old, they (the deserving intellectuals) are "discarded" or persecuted if they don't toe the line and serve the political masters.

They have failed to understand that "extremism in the defense of liberty is no vice, and that moderation in the pursuit of justice is no virtue" (Barry Goldwater). The rulers of Malaysia do not see that it is sinful and tyrrannical to "compel a man to subsidize with his taxes, the propagation of ideas which he disbelieves and abhors"(Jefferson).
BN understands the human spirit (which is often dulled by sectarianism and brute force), but have yet to see its fury unleashed through whatever means available, when all avenues are exhausted. That being the case, should the mandate for the legitimacy of rulers not be returned to the people, (just as TDI predicted in the sixties while debating the ISA) the backlash by the common man will come to pass - sooner or later.

To Zambry I say -

Swinging the Pendulum ....

PERAK - Appeals Court grants Zambry a stay of execution in Perak MB tussle.

The above stay application at the court of appeals despite being one of great public interest, was apparently heard by a single judge!!! With that judgment, it means that Nizar is once again "no more MB", barely a day after being declared the legitimate MB.
Accordingly, before vacating the office, Nizar said, "Whatever court action, we need to sincerely stop the impasse. The only remedial action that can stop this impasse is a dissolution of the assembly."

Shafee, the BN lawyer (while at it) apparently cited an obscure case in Africa to state that the MB does not need a vote of no confidence to be sacked, while the case of Stephen Kalong Ningkan in Sarawak, stares at his face. It is precisely these kind of perverted minds that bring about the subversion of the Federal Constitution, while promoting the law of the jungle (as was seen in the Perak DUN).

Only yesterday at Umno Baru's 21st (and Umno’s 63rd) anniversary celebrations, Najib mentioned that :-
"We must change in accordance to our constitution and national principles.”
... he called for "working together, transcending partisan politics", and now, he wants to keep playing the ding dong game, while Perak languishes.
So much for Najib's call for upholding the constitution and working for the rakyat.


As far as I know, the Constitution does not prescribe the election of a speaker without convening the assembly, nor does it allow for physically evicting the speaker from his seat of power.

Maybe his principle is that of using brute force to (literally) grab the seat of power, at whatever cost. His understanding of the constitution is probaly that it is meant to serve UMNO, and not vice versa.

In all likelihood, he believes that what Ku Li said in his blog (above) probably doesn't apply to pirates who seek to control seats of power, while subverting the state. A man like Najib would most likely fall for the temptation of power, and would seek to consolidate it using whatever instrument at his disposal, with no regard for the Federal (or State) Constitution. He's quite unlikely to know or feel any shame towards this end.

Najib with his flip-flopping and dubious "stimulus packages" is hardly a leader of the people, and is unlikely to be able to reign in the party's warlords who hunger for money and power (which led to the Perak fiasco) - no matter what Mahathir may say of him. (Most probably Mahathir just says the things he does about Najib, for the simple reason that he's "pliable" - considering the controversies surrounding him and his Mrs.).

Someone once said, "Conservatives aren't necessarily stupid - but the stupid are inevitably conservative" ... and that is what Umno knows, and wishes to capitalize on. they would seek to harness the "power of stupidity" among its less than average minds.
Being weak, Najib/ Umno will probably start with the Ketuanan Melayu rhetoric once again to shore up their "conservative" base, and push forward the racists' agenda of piracy. They will try every trick in the book to portray all controversies with a racist slant to it - which is precisely what they did in Perak - while hiding the hands that steal, plunder and rape the economy.
It is all about "money" - and little to do with "race" (as RPK had written is haste) which they would want you to believe.

It is quite likely that we will be having a mid-term elections which will be Najib's Waterloo. Having the weak leadership qualities and a coterie of imbeciles around him, he would almost certainly advocate the complete destruction of all institutions of democracy which we have (to complete the job of his "guru"). Going by the happenings in Umno now, despite all the calls for "change" ad nauseaum, it is most likely that they will turn Malaysia into a full fledged fascist pariah state in due time.

There was a time when I did give Umno/BN the benefit of doubt - in that, I hoped that they might "change". However, after the events that have transpired of late, all hope for reforms among these pirates have been abandoned. Day by day, BN only reinforces the idea than they have no sense of justice and do not understand "statecraft".
To the people now, the only hope for Malaysia to achieve "nationhood", is to get rid of this fascist party at the next elections.
Till then, it's que sera sera ....

Nizar's back!!! Dissolve The Assembly Now!!

KUALA LUMPUR: The High Court here ruled rule on Monday that Datuk Seri Mohammad Nizar Jamaluddin is the rightful Perak Mentri Besar, and not Barisan Nasional’s Datuk Seri Dr Zambry Abdul Kadir.

In an immediate response, Zambry said he would apply for a stay pending appeal. This was rejected by the court.

Nizar left the courtroom saying he would seek an audience with the Sultan of Perak, Sultan Azlan Shah, to get his consent to dissolve the Assembly and call for fresh state elections.

He would make his request for the audience at a state function at the Istana Kuala Kangsar Tuesday morning.

In his ruling Monday, Justice Abdul Aziz Abd Rahim said that a new mentri besar could not be appointed as the office had not been vacated.

He said a mentri besar can only be dismissed by a vote of no confidence, and upheld the Stephen Kalong Ningkan ruling.

He noted that the Perak State Legislative did not hold a vote of no confidence.

Happy Wesak! Respect My Speech!


Today we have the Chief Pirates of Malaysia wishing all Buddhists a Happy Wesak, extolling the virtues of Buddhism, Buddhists and their organizations. To add insult to this injury, they would at the same time try to draw parallels with the Umno/BN regime which stands diametrically opposed to anything that preaches virtue.

Incidently, I had a very vivid dream last night - after reading some "stories" on the internet. There was this grand old man who was the head of the family & clan, who had returned home for a yearly celebration. He was much revered by his children and all members of the clan.

As per protocol in this traditional family,
all of them gave him a warm welcome with much pomp and splendour. This year though, he came with company - a new concubine (that's a polite way of saying "whore") supplied by the thugs/pimps who worked "for him" in his vast business empire.

Before he took his seat at the head of the table, in full view of the whole clan, he got his bodyguards to drag the mother to his children (who objected to his philandering) by the hair- out of the dining hall amidst much protests from his children, and approval & praises from his bastard children. The concubine then took the seat of the mother to his legitimate children, beside him.
Meanwhile prior to the customary speech (no - it wasn't an officiating speech)before the meal, the bastard son said grace, thanking God for the food on the table.
When the children protested once again, with much composure and "grace" he warned them with his arms around the whore,
"If you want to remain here & work with me, Respect my speech!"

That was my dream - I then woke up to this "Happy Wesak Day"!
BTW, Najib & Hishamudin are the Santa Claus & Santarina ......

Police mockery of right to legal access


THE Malaysian Bar strongly condemns the arrest last night of five lawyers at the Brickfields police station who were there to represent their clients.

We are shocked and disgusted by this blatant transgression of the rule of law. By their action, the police personnel in question have demonstrated utter disrespect and blatant disregard for the criminal justice system that they are duty-bound to uphold and protect. They have violated the specific provisions in the Criminal Procedure Code guaranteeing access to lawyers. Although there is an exception to this provision, it cannot by any stretch of the imagination be turned into a right to arrest lawyers who are waiting to render legal representation to their clients.

The police action makes an absolute mockery of the constitutional right to legal representation and is a travesty of justice. We call on the Inspector-General of Police to immediately explain this gross abuse of police power.

This unprecedented conduct by the police has far-reaching consequences. It means arrested persons can be denied access to their lawyers without challenge. And when their lawyers are denied access and are forced to wait outside the police station, the lawyers themselves are at risk of arrest.

We acknowledge all our colleagues who have come to the aid and defence of those arrested by the police simply because they have chosen to exercise their fundamental right to assemble peaceably.

We salute our colleagues from the Kuala Lumpur Legal Aid Centre — Fadiah Nadwa Fikri, Murnie Hidayah Anuar, Puspawati Rosman, Ravinder Singh Dhalliwal and Syuhaini Safwan — who, without regard for their own safety and well-being, voluntarily went to the aid of those arrested, only to be arrested themselves. They have exhibited great courage and by their actions have demonstrated the highest standards of the Malaysian Bar. Their exemplary sense of duty and professionalism stands in stark contrast to the despicable conduct of the police.

Hishamudin, being armed with his arsenal of security/enforcers in the PDRM (as he's now the Home Minister), has little reason to wave the kris. No more threats, no more calls for "uprisings".
His job now is to snuff out any form of dissent - constitutional or otherwise. It is all his prerogative. He now can order arrests with total impunity.
He can also take away or give you your freedom with no reason whatsoever. But of course the copper will tell you that they need 1001 investigations & reports they have to make before that is done under the ISA. However, you can rest assured that in the Malaysia Boleh spirit, these things can be done in a jiffy - like the time they put that journalist (Ms. Tan, I believe) in the slammer "for her own safety & protection".

After the BN government sponsored coup d'etat, with Perak now under the rule of Pirates who have made mincemeat of democracy and all the institutions that are its pillars (that too, graced by a Raja Nazrin who apparently "didn't officiate - but just gave a speech" which had to be "respected", to kill some time, of course), it is now time for "santa claus" to dish out some goodies.

Yes it's time to see the "goodwill" of pirates turned santa claus! It's time to sing praises to Hishamudin, the Kris man who now shows what a caring Umno/BN regime we have!

Quoted above is the abstract of a paper which I posted here under the title Crouching Monkey, Wounded Tiger (I of III) on the matter of "election/power stealing" phenomenon in many third-world states. Read also in the same post, papers which made Malaysia a case study of "third-world" regimes in the same league as Egypt. With the Perak fiasco, the Umno/ BN regime has once again shown its primitive attitude, and vindicated the "western intellectuals/media" it is so prone to demonize.

It is a sad day for Democracy in Malaysia.
Today, without formally convening of the assembly, a new speaker was installed despite having the motion rejected by the legitimate speaker. They have used brute force, and not the law/Constitution to remove the Speaker from his seat.

As I had mentioned during the aftermath of the 080308 tsunami - the aristocracy has inevitably expressed their contempt for the rule of law and democracy, and have unleashed their vengeance - and their anger has by no means been cooled. There's more to come, and the PR would best be on guard.
It was something I expected about six to eight months down the line. However, that it had taken this long is probably evidence of the problems faced among the elements of the ruling elite in theBN/ Umno regime. The Barisan Nasional Government has shown that it does not care for anything other than the Power to rule.
The electorate are robbed of their legitimate rights.
The Federal Constitution is "Dead".
The State Constitution is "Dead".
The Judiciary is "Dead".
Rule of Law is "Dead".
The "PDRM" is "Dead".
Democracy is "Dead".

Only the Army remains (a scary thought, but does it actually still remain?) ......
The rest have all been emasculated, and "Kuganized" - and illegitimate bodies led by thugs have usurped their powers to install goons or puppets in their place.
Save in a few states under the Pakatan Rakyat governments, Malaysia is fast descending into lawlessness - enforced by pirates who have installed themselves into the seat of power. Malaysia will soon be officially declared a "pariah state" with a pariah institutions of state - which has interestingly been official.

I will not pretend that this was something which was unexpected any more than that pirates wouldn't take losses without playing dirty. However, to the PR - this is also a test of their allegiance to the head of state. I'm certain that all PR leaders knew this as well. It is just that they have displayed much restraint so as not to provoke "civil strife" - which is exactly what the pirates want.
They are looking for an excuse to trigger violence of some sort, and didn't get it. It is for this reason that DSAI was not to be seen anywhere near the venue of the confrontation.

Maybe patience would be the order of the day as HRH Sultan Azlan Shah quoted from the Quran,
O you who believe! seek assistance through patience and prayer; surely Allah is with the patient. (The Cow 2.153 )”.

What we have seen is actually a mortally wounded animal unleashing its fury with all its might in its throes of death.
Let it be known that this is just the beginning.
It is the beginning of the end of Umno/ BN - and there will be more injustice heaped upon the people before it dies.

No power can survive without the media. With the MSM media which has been widely discredited for spinning lies, this BN/ Umno regime will not last long - maybe not even 5 yrs.
They have lost the propaganda war, and now it is just a matter of time before this illegitimate government falls. They have just signed their death warrant - and it will be a slow and painful death ..... with their eyes wide open.

Malaysia is today not just a "Police State", but also what Noam Chomsky would call a "death squad democracy" which is ripe for economic colonization, after the plunder by the pirates we've had thus far.
The only question now is, if the army will sooner or later "intervene" to keep the country in one piece .......
